Town Clerk: Unopened Absentee Ballot Erroneously Marked "Deceased"

An absentee ballot marked "deceased" in error prior to the August 14 primary may give one of the three Democratic candidates in the contested fifth Assembly district race another vote.

During Monday's recount of Windsor votes cast in the August 14 primary, the attention of recanvass observers turned to an unopened absentee ballot.

The ballot, according to elections staff was marked "deceased," and unopened because the voter was believed to have died prior to Primary Day.

According to the Windsor Town Clerk's office, however, it has been discovered that the voter "is alive and well," making their vote valid in the primary.

The envelope has not been opened, and elections staff plan on nailing down a course of action regarding the vote Tuesday evening. It is unknown whether the ballot includes a vote for Leo Canty, Brandon McGee or Don Trinks.

This case will return to court Wednesday morning, where Judge A. Susan Peck will examine the results of the recount.
